The duty to manage asbestos: what the dutyholder must do, and how a commercial asbestos-cement roof stays compliant

Regulation 4 asks the dutyholder to find the asbestos or presume it, keep a register, assess the risk, act on a written plan and tell anyone who may disturb it. A retained asbestos-cement roof stays in that paperwork; our part is the specified treatment and the record of our own work.

The short answer

The duty to manage asbestos is set by regulation 4 of the Control of Asbestos Regulations 2012 and covers non-domestic premises. The dutyholder must find out whether asbestos is present, presume it is unless there is strong evidence otherwise, keep a register, assess the risk, act on a written plan and inform anyone liable to disturb it.

Regulation 4Control of Asbestos Regulations 2012, non-domestic premises
Eight stepsfrom checking who has the duty to review and record
Your registerthe roof stays in it after encapsulation; you add our work record

Keeping the sheets in place does not finish the paperwork. Their condition, completed work and next inspection still belong in the register and management plan.

01What the duty is

What the duty to manage asbestos is

The duty is about how the whole building is managed, not one roof job. Regulation 4 concerns identifying and managing asbestos in non-domestic premises. That includes warehouses, industrial units, farm buildings, offices, schools and commercial venues.

The duty also covers common parts of multi-occupancy domestic premises, outside this guide. This explanation of HSE guidance and regulation 4 is not legal advice. Take competent asbestos advice for your premises and planned work.

HOLVEM is not an asbestos surveyor. We do not write asbestos management plans or keep anyone's asbestos register. Our part is the specified roof treatment and the record of our own work for you to add to your building's records.

02Who holds the duty

Who the dutyholder is

Before arranging work, establish the maintenance responsibility. Regulation 4(1) looks at contract or tenancy obligations and, without those, control of the premises. The duty can be shared.

Use HSE's check if you have the duty page alongside the lease or maintenance agreement. Managing agents and tenants should check the lease.

Where responsibilities are shared, agree who supplies records, authorises work and updates the plan afterwards.

03The eight steps

What the dutyholder must do: the eight steps

Once responsibility is clear, follow the duty through from finding the material to recording what happens to it. This table follows HSE's duty guide; the regulation references show the legal provisions behind the steps.

StepRegulation 4 referenceWhat it means for the roof
Check who has the duty.4(1), contractual obligations or control.Identify the roof's maintenance responsibility, including any shared duties.
Find out whether asbestos is present.4(3) to 4(5), assessment, condition and relevant building information.Use the building history and records; presume suspect material contains asbestos unless strong evidence shows otherwise.
Arrange the appropriate survey.4(3) to 4(5), the assessment provisions; HSE's survey guidance.Your asbestos surveyor establishes the information the proposed work needs.
Make a register and assess the risk.4(7) and 4(8), recorded assessment and risk determination.Locate the sheets, record condition and inspection dates, and assess the planned activity.
Write the management plan.4(8), a written plan and specified measures.Set the actions, responsibilities and monitoring arrangements for the retained roof.
Put the plan into action.4(9)(b), “properly maintained or where necessary safely removed”.Use the appropriate competent contractor for the agreed roof work.
Tell anyone liable to disturb it.4(9)(c), information “provided to every person liable to disturb it”.Give roof information to contractors before work, and make it available to emergency services.
Review and record.4(10), plan review, implementation and recorded measures.Update the entry after work and review the plan when circumstances change.

A contractor's completion pack supports the record; it does not replace the assessment, register or plan.

One sequence, and the dutyholder owns every step of it. The roof contractor appears at six, seven and eight, and only with its own work.

04The regulations

The asbestos regulations behind the duty

Those steps sit under the Control of Asbestos Regulations 2012, SI 2012/632. Regulation 4 is the duty-to-manage provision. HSE's approved code of practice, L143, Managing and working with asbestos, explains the regulations alongside their supporting guidance.

05Which survey

Asbestos surveys: management or refurbishment and demolition

Next, establish what information the job needs. An insulation visit is not an asbestos survey. HSE describes two survey types.

SurveyPurposeInspection approach
Management surveySupports the register and management plan during normal occupation and use.Includes reasonably accessible areas and can involve sampling and minor intrusion. Record any areas not inspected.
Refurbishment or demolition surveyLocates material, including hidden material, for the planned refurbishment or demolition.Involves destructive inspection of the relevant areas by a competent surveyor.

HSE's survey guidance points to HSG264, Asbestos: The survey guide, and strongly recommends accredited asbestos surveying organisations. Analysis of a sample confirms whether a suspect material contains asbestos. A photograph of a corrugated sheet cannot do that.

Your asbestos surveyor decides which survey the planned work needs. Tell them the proposed activity, access and fixings. HOLVEM asks for the building's survey or register; we do not decide which survey a job needs.

06Register and plan

The asbestos register and the management plan

With the survey in hand, keep the register useful to an arriving contractor: known and presumed materials, locations, amounts, condition, inspection dates and the assessment setting priorities.

HSE calls the register “a live document which must always contain current information”; its register guidance sets out what it holds. Keep subsequent work records alongside the survey.

Keeping the sheets in place does not finish the paperwork.

The plan sets responsibilities, monitoring, information sharing, control arrangements and emergency procedures. HSE's duty overview says to review the plan “every 12 months or sooner if necessary”. This plan-review interval is separate from the inspection frequency set for individual materials by the competent assessment.

HSE's plan guidance lists review triggers, including “whenever work takes place that affects ACMs”. After roof treatment, review what the plan now needs and record the action taken.

07Telling contractors

Telling anyone who may disturb it

The records matter before a contractor arrives, as well as afterwards. HSE's instruction is clear: “You must tell workers before they start work on the fabric of your building.” Its information-sharing guidance says planned-work information should arrive early, for example when asking for a quote.

Give the contractor the roof's register entry and site plan, condition information, relevant plan arrangements and site contact. Include uninspected areas and the surveyor's recorded restrictions.

Regulation 4 also provides for information to be available to emergency services. Keep the current record accessible.

08The roof entry

Where the roof fits: asbestos-cement sheets in the register

Now look at the roof entry itself. HSE says asbestos can remain in buildings built or refurbished before 2000. The building's age is a reason to check, rather than proof of what every sheet contains. Record whether the material is sampled or presumed, following the survey information.

Access needs its own plan. HSE's roof-work guidance says to treat roofs as fragile until a competent person confirms otherwise. Take enquiry photographs from safe positions; stay off the roof. Insulation or coating does not make the sheets suitable to walk on.

Photographs of the underside help us see the treatment area. Tell us about anything they cannot show; they never replace the material assessment.

09A retained roof

Keeping a retained asbestos-cement roof compliant

Once the survey and assessment are clear, the management plan can weigh the work needed. HSE's plan-into-action guidance includes leaving material in place and managing it, or repairing, sealing, enclosing or removing it as appropriate. Retaining a roof is an active management choice.

With competent asbestos advice, the roof's condition and the planned activity decide the route. Encapsulation leaves the material in the building, still covered by the register and plan.

Each task's category is set by the contractor doing it, following HSE's guidance, so removal and encapsulation are assessed separately. Do not assume all asbestos-cement work is licensed, or that one contractor's category covers another contractor's job.

Read your options for a corrugated asbestos roof and asbestos roof repair for the practical work.

10Encapsulation and the record

Encapsulating from below, and what goes back into the register

If the agreed route is to retain and treat the roof, our work starts from your survey or register. HOLVEM does not test for asbestos or replace roof sheets, and never removes asbestos sheets. If the roof is safe to keep, we encapsulate it; if not, removal is a job for asbestos removal professionals, licensed where HSE requires it.

We encapsulate an asbestos-cement roof from below to the written specification. Applied thickness is measured and recorded, coverage logged, and the QA evidence pack handed over at completion. It records what was applied, where, at what depth and when. You add our work record to your register and review the roof's management arrangements with your adviser.

Where condensation is part of the brief, keep its diagnosis separate from roof leaks. Correctly diagnosed and specified, closed-cell spray foam stops roof condensation. The depth is typically 25 mm or 50 mm closed-cell, depending on the roof make-up, confirmed before we spray, with a condensation risk analysis where needed.

Existing leaks go to a roofer first. HOLVEM is not a roofing contractor and spray foam is not waterproofing.

11When it cannot stay

When the roof cannot stay

If the assessment rules out retaining the sheets, the project moves to the appropriate removal professionals. HOLVEM does not test for asbestos or replace roof sheets, and never removes asbestos sheets. If the roof is safe to keep, we encapsulate it; if not, removal is a job for asbestos removal professionals, licensed where HSE requires it.

For budgeting, removal and disposal alone on a large, straightforward roof typically costs £20 to £40/m² + VAT. Small, damaged, fragile or hard-to-reach work can be £60 to £100/m² or more. Scaffold and access are usually extra. Removal and replacement typically runs £100 to £160/m² + VAT.

Typical UK industry figures, 2026. Send photographs or drawings for a free estimate.

See asbestos roof removal cost for the removal comparison. Those figures describe other contractors' methods; HOLVEM does not offer sheet removal.

12What it costs

What keeping the roof costs

When the roof can be retained, compare the proposed work with the alternative methods on the same area. Foam depth and objective belong in the specification, so you know what the price is buying.

MethodTypical price basis
HOLVEM closed-cell foam, 25 mm£16 to £25/m² + VAT.
HOLVEM closed-cell foam, 50 mm£22 to £35/m² + VAT.
Overcladding£60 to £90/m².
Panels or replacement£100 to £160/m².

Typical UK industry figures, 2026. Send photographs or drawings for a free estimate.

The cost guide sets out the method comparison. External foam-and-coating work is a separate specification and is not priced inside the underside foam-alone bands.

The right photographs & measurements often get you a free, same-day estimate, no survey needed. Our virtual survey uses aerial imagery alongside the photographs or drawings. It is a roof estimate, not an asbestos survey.

How it works: Send photographs or drawings → free, same-day estimate with a virtual survey → confirmed on install, or a free survey and firm written quote for larger jobs.

Straightforward jobs are confirmed on installation day before work starts. Larger or complex jobs get a free HOLVEM survey first, then a firm written quote. No obligation either way.

A binding quotation is issued in writing before work starts, from a survey or from the photographs and drawings you send.

13Roofs kept in place

Commercial asbestos-cement roofs kept in place

Three completed jobs show what different retained-roof specifications involve.

At the 2340 m² asbestos-cement roof, we applied 50 mm of closed-cell foam from below. The sheets stayed in place; nothing on the roof was walked on, cut or removed. The customer reported that condensation on the roof underside was mitigated following installation. The application record was issued on 15 June 2026.

At Black Hangar Studios, Alton, we sealed 4000 m² from below with a 25 mm closed-cell base and 150 to 200 mm of open-cell foam above it. The job took three weeks on site in April 2021, with nothing cut or removed. The studio reported that the drumming and resonance from rain and wind were virtually eliminated.

At Global House, Surbiton, the work was from above: preparation with a low-pressure biocidal wash, 25 mm of closed-cell roofing foam in lifts and a silicone coating across 1575 m². Nothing was cut, lifted or broken. This was one external coating system; HOLVEM washes a roof only as preparation before a coating, never as a standalone service.

14Why HOLVEM

Why HOLVEM

If your asbestos register already lists the roof, the job is to keep that roof sound, in place and on record.

  • A roof that stays in place. At Black Hangar, we sealed 4000 m² from below in three weeks without cutting or removing sheets. No strip-out, no skips of asbestos, no roof left open to the weather.
  • Your paperwork comes first. We ask for the building's asbestos survey or register before we price or spray. Sheet removal is never part of our work.
  • An application record you can use. We specify certified spray foam systems, which we apply as an accredited installer for the manufacturer. Recorded thickness, locations and dates sit in the QA evidence pack, ready for your register and plan review, and for surveyors, insurers or buyers to examine.
  • A cost comparison for the plan. Foam starts at £16/m² + VAT; overcladding typically runs £60 to £90/m² and replacement £100 to £160/m². Typical UK industry figures, 2026. Send photographs or drawings for a free estimate.
  • Warranty documents issued to you. Backed by a 25 year product and workmanship warranty.

Attach the roof's register entry and the management plan's roof section, if you have them, so we can start from the recorded building.

16Questions, answered

FAQ

Who is responsible for the duty to manage asbestos?

The person with maintenance or repair obligations under a contract or tenancy, or relevant control where no such arrangement exists. Duties can be shared. Check regulation 4(1), the lease and HSE's dutyholder guidance.

When was the duty to manage asbestos introduced?

Regulation 4 of the Control of Asbestos at Work Regulations 2002 came into force on 21 May 2004, as stated in regulation 1. The duty now sits in regulation 4 of the 2012 regulations.

Does the duty to manage apply to my building?

It covers non-domestic premises and common parts of multi-occupancy domestic premises. This guide addresses commercial roofs. Use HSE's duty check for your responsibilities.

What is the difference between a management survey and a refurbishment and demolition survey?

A management survey supports normal occupation and management. A refurbishment or demolition survey addresses the planned works, including hidden material. Your asbestos surveyor decides which information and survey the job needs.

How often should the asbestos management plan be reviewed?

HSE's overview says every 12 months or sooner if necessary. Review it when work affects asbestos-containing materials or other relevant circumstances change. The material-inspection schedule is set separately through competent assessment.

Can an asbestos-cement roof stay in place?

Retaining and managing material is one route in HSE's guidance. The asbestos survey, condition assessment and planned activity decide whether it suits your roof. Keeping the sheets leaves an ongoing register and management-plan responsibility. To weigh it up, see whether to keep or replace an asbestos-cement roof.

Does encapsulating an asbestos roof need a licensed contractor?

Each task's category is set by the contractor doing it, following HSE's guidance, so removal and encapsulation are assessed separately. There is no blanket answer that all asbestos-cement work is licensed.

What should I give a contractor before roof work?

The roof's register and site-plan information, condition assessment, relevant plan arrangements and site contact. HSE says planned-work information should be shared early, including when requesting a quote, and before work starts.

What records should I keep after the roof is encapsulated?

Keep the specification, application locations, measured depth, date, contractor and QA pack. Add the work record to your register and review the management plan with your adviser. Encapsulation does not remove the original material from the register.

17In five lines

The duty to manage asbestos, in five lines.

  1. Regulation 4 of the Control of Asbestos Regulations 2012 puts the duty on whoever holds the maintenance obligation or control of non-domestic premises; it can be shared, so check the lease first.
  2. Find the asbestos or presume it, arrange the survey the work needs, keep a live register, assess the risk and act on a written plan, reviewed every 12 months or sooner if necessary.
  3. Tell anyone liable to disturb the roof before they start, at quote stage where you can: the register entry, site plan, condition, plan arrangements and site contact.
  4. A retained asbestos-cement roof stays in the register. After encapsulation from below, add the work record: what was applied, where, at what depth and when, with the specification and QA pack reference.
  5. HOLVEM does not test for asbestos or replace roof sheets, and never removes asbestos sheets. If the roof is safe to keep, we encapsulate it; if not, removal is a job for asbestos removal professionals, licensed where HSE requires it.
